In my opionion no it shouldnt stop your ex from paying. Have a look at www.cmoptions.org which is in the article. It's a goverment funded service to give advice and support on maintenance matters.

I am considering going to the CSA for maintenance. MY ex is retired, gets pension,so no 'income' from a job or business, and has not paid maintenance for years. My kids are 9 and 11. I have very little income, but do not claim benefits because I live with my boyfriend, and that negates any benefits I could claim. However, should that stop my ex from paying maintenance? It's not my boyfriends job to support my kids. Any suggestions on this?
